A tax deduction of up to $1.80 per square foot is available to owners or designers of new or existing commercial buildings that save at least 50% of the heating and cooling energy of a building that meets ASHRAE Standard 90.1-2001. Partial deductions of up to $.60 per square foot can be taken for measures affecting any one of three building systems: the building envelope, lighting, or heating and cooling systems. On-Site Renewable Tax Incentive
Businesses are eligible for tax credits for qualified solar water heating and photovoltaic systems, and for certain solar lighting systems. Qualifying equipment will either use solar energy to generate electricity, to heat/cool or provide hot water to a structure, or will use solar energy to illuminate the inside of a building by means of fiber-optic distributed sunlight (tube systems and passive solar are not eligible). The credits are available for systems placed in service between January 1, 2006 and December 31, 2016.

Non-residential managers can receive a 10-year tax credit if they help create renewable energy from one of the following sources: wind, closed loop biomass, open loop biomass, geothermal, solar, small irrigation power, municipal solid waste, and refined coal.

Small Ethanol Producer Tax Credit
A small ethanol producer that is registered with the Internal Revenue Service may be eligible for a tax incentive in the amount of $0.10 per gallon of ethanol that is: sold and used by the purchaser in the purchaser's trade or business to produce an ethanol fuel mixture; sold and used by the purchaser as a fuel in a trade or business; sold at retail for use as a motor vehicle fuel; used by the producer in a trade or business to produce an ethanol fuel mixture; or used by the producer as a fuel in a trade or business. A small producer is one that has, at all times during the tax year, not more than 60 million gallons of productive capacity of any type of alcohol. The incentive applies only to the first 15 million gallons of ethanol produced in a tax year and is allowed as a credit against the producer's income tax liability. Under current law, this incentive expires December 31, 2010.

Oklahoma Green Grant
The U.S. Department of Labor has awarded Oklahoma a $6 million green-job grant to train workers in emerging industries such as energy efficiency and renewable energy. The goal is to train 4,700 workers in two years for jobs that pay above the state's per capita income.

Payments for Specified Energy Property in Lieu of Tax Credits
ARRA authorizes the Department of the Treasury to make payments to eligible persons that either place in service particular types of energy property in 2009 or 2010, or, under certain circumstances, begin construction on such property in 2009 or 2010. These payments are generally equal to 10 or 30 percent of the eligible cost basis of the property, depending on the type of property. Those that apply for these payments must forego tax credits that they could otherwise receive under sections 45 and 48 of the Internal Revenue Code. The types of energy property that are eligible for these payments include, among others, various renewable energy generation facilities, microturbines, and fuel cells.

Production Tax Credit (PTC)
Through the 2009 American Recovery and Reinvestment Act, Congress acted to provide a three-year extension of the PTC through December 31, 2012. Additionally, wind project developers can choose to receive a 30% investment tax credit (ITC) in place of the PTC for facilities placed in service in 2009 and 2010, and also for facilities placed in service before 2013 if construction begins before the end of 2010. The ITC then qualifies to be converted to a grant from the Department of Treasury. The Treasury Department must pay the grant within 60 days of an application being submitted.
