Docket for Notice of Proposed Rulemaking: Replacement Fuel Goal (RIN 1904-AB67)
In March 2006, the U.S. District Court for the Northern District of California vacated the U.S. Department of Energy's (DOE) January 2004 decision not to implement an alternative fuel vehicle mandate for private and local government fleets. The Court directed DOE to issue a draft rule on the replacement fuel goal and complete draft and final determinations on the Private and Local Government Fleet Rule in compliance with the Court Order. As the first part of the compliance action, DOE issued a Notice of Proposed Rulemaking modifying the EPAct 1992 Replacement Fuel Goal to make it more achievable.
This publicly available docket provides the documentation related to DOE's proposed rulemaking. It includes the Notice of Proposed Rulemaking, public comments, and supporting documents.
Due to technical difficulties in receiving electronic comments on the proposed rule for the Replacement Fuel Goal, the comment period, which originally ended on November 3, 2006, was extended until January 31, 2007. A notice to this effect was published in the Federal Register on January 18, 2007 (see below). All comments received by DOE are posted in section C., Written Comments, below.
On March 6, 2007, DOE signed the final rule on the Replacement Fuel Goal. It was published in the Federal Register on March 15, 2007 (PDF 226 KB).
