Docket for Rulemaking on Private and Local Government Fleet Determination: (EE-RM-FCVT-03-001)

Section 507(e), (42 U.S.C. 13257(e)), of the Energy Policy Act (EPAct ) instructs the DOE to determine whether private and local government fleets should be required to acquire alternative fuel vehicles (AFVs). Unlike the current fleet mandates for Federal alternative fuel provider and state government fleets, authority to implement regulations affecting private and local government fleets is conditioned on DOE determining that the fleet mandate is necessary to achieve the replacement fuel goals contained in section 502(b)(2) of EPAct (42 U.S.C. 13252).

In March 2003, DOE published a notice of proposed rulemaking (NOPR). In it, DOE explains that a mandatory acquisition of AFVs by private and local government fleets would result in only a negligible increase in replacement fuel use and therefore under EPAct is not necessary.

Public comments on the rulemaking were accepted through June 2, 2003. Submitted comments are listed below under "Comments and Additional Data."

Prior to issuing this NOPR, DOE issued an advanced NOPR and held a series of workshops to discuss issues related to implement a private and local government fleet mandate. A public hearing was also held.
