Docket for Notice of Proposed Rulemaking: Alternative Fuel Transportation; Private and Local Government Fleet Determination (RIN 1904-AB69)

In March 2006, the U.S. District Court for the Northern District of California vacated the U.S. Department of Energy's (DOE) January 2004 decision not to implement an alternative fuel vehicle mandate for private and local government fleets. The Court directed DOE to issue a draft rule on the Replacement Fuel Goal and complete draft and final determinations on the Private and Local Government Fleet Rule in compliance with the Court order.

In compliance with the Court's order, DOE issued a Notice of Proposed Rulemaking (NOPR) regarding DOE's proposed decision regarding implementation of an alternative fuel vehicle acquisition mandate for private and local government fleets. The proposed rule reflects the new Replacement Fuel Goal DOE issued in March 2007, as noted above.

On March 6, 2008, DOE signed the final rule (PDF 177 KB) on the Private and Local Government Fleet determination.
