Commercial Prerinse Spray Valves

The Energy Policy and Conservation Act, as amended, 42 U.S.C. 6291–6317 establishes energy conservation standards and test procedures for certain commercial and industrial equipment, including commercial prerinse spray valves. The Code of Federal Regulations (CFR), defines the term “commercial prerinse spray valve” to mean a handheld device that has a release-to-close valve and is suitable for removing food residue from food service items before cleaning them in commercial dishwashingor ware washing equipment. DOE last amended energy conservation standards for commercial prerinse spray valves through a final rule published in the Federal Register on January 27, 2016.

Recent and Ongoing Activities

DOE has published a Federal Register notice of final determination pertaining to energy conservation standards for commercial prerinse spray valves. The Energy Policy and Conservation Act (EPCA) requires DOE to periodically determine whether more stringent, amended standards would be technologically feasible and economically justified, and would result in significant energy savings. In this final determination, DOE has determined that amended energy conservation standards for commercial prerinse spray valves are not needed.

Current Standard

Commercial prerinse spray valves manufactured and distributed in commerce, as defined by 42 U.S.C. 6291 (10) and (16), must meet the energy conservation standards specified in the Code of Federal Regulations at 10 CFR 431.266.


Current Test Procedure

To determine that commercial prerinse spray valves that are currently manufactured or distributed into commerce are in compliance with DOE standards, manufacturers must follow the test procedure methods specified at 10 CFR 431.264.

Exceptions

DOE's Office of Hearings and Appeals has not authorized exception relief for commercial prerinse spray valves.

State Exemptions to Federal Pre-emption

DOE has not exempted any state from this energy conservation standard. States may petition DOE to exempt a state regulation from preemption by the Federal energy conservation standard. States may also petition DOE to withdraw such exemptions. For details, see 10 CFR part 430, subpart D.
